Graham Brodie KC secures dismissal of charge of perverting the course of justice

Yesterday brought a five-year saga to an end when Graham successfully argued that a judge should dismiss before trial a charge of perverting the course of justice.

The proceedings concerned an allegation that a director and senior executives of a civil engineering business had drafted back-dated policy and procedure documents in order to mislead the HSE that those documents existed at the time of a workplace accident and, thereby, persuade the HSE not to commence criminal proceedings against the company. Following lengthy submissions concerning the evidence on which the prosecution proposed to rely, the court concluded that the prosecution case was insufficient for any of the defendants to be properly convicted.
